Your use of this site is expressly conditioned on your
acceptance of the Terms and Conditions. By using this site, you
agree unconditionally and accept to be legally bound by the
Terms and Conditions stated. If you do not agree with any part
of the Terms and Conditions, please discontinue your use of this
site and/or the products and services offered herein. The Terms
and Conditions apply to the use of the site and the products and
services offered herein.
In this context, the company refers to Planet Travel Pte Ltd;
third party refers to other travel agents, travel service
providers such as air, cruise and coach providers and National
Tourist Organizations involved in your travel arrangements. The
products and services are provided by both the company and/or
third parties where required. Hence, their (third parties) own
specific governing terms and conditions shall apply in addition
to the Terms and Conditions. These specific terms and conditions
for a particular product or service shall include any terms and
conditions found on your screens and when using any part of this
site. In the event of any inconsistency between the specific
terms and conditions for a particular product or service and the
Terms and Conditions, the specific terms and conditions for the
particular product or service shall prevail in relation to that
particular product or service. Site user/s should also
understand that all prices or rate on this site is in Singapore
Dollars unless stated.
GENERAL PROVISIONS
Your use of this travel web site and on-line reservation
facilities such as 'booking form' and 'booking online' here-by
referred to as the 'booking system' is subject to the following
Standard Terms of Service and Trade:
- Ownership of
Intellectual Property Rights
The content of this travel web site including booking system
trademark, design rights, copyrights, database rights and
know-how belong to the provider of this site ('Planet Travel
Pte Ltd'). Unauthorized use is strictly prohibited. All
title, ownership rights, intellectual property rights and
copyright, rest with the company (www.planettravel.com.sg).
- Accuracy of
information and limitation of liability
The Company does not endorse or recommend any particular
travel service provider. The company and its third party
suppliers have taken reasonable care to ensure that the
content of this travel web site, including all travel
information and listings is correct but is subject to
amendment at any time without notice. The company publishes
such information in good faith. As user, you acknowledge and
accept that.
The company cannot and has not checked the accuracy of all
information provided by third parties. The product listings
may include errors and third parties are requested and
encouraged to correct and update their information regularly
and when needed. The company will not be responsible for
errors, omissions or misleading information in travel
information and listings. You should make your own
evaluation of the accuracy or completeness of any
information, opinion, advice or other content available
through the facility.
You are solely responsible for the suitability of any travel
services purchased by you through this service. In
particular, you undertake not to hold The Company liable for
any inconvenience caused or expense incurred as a result of
any unsuitability of travel services for use in association
with other travel services. In cases whereby your travel
arrangements involves third parties, our role is merely
limited to that of a facilitator between you and the third
parties in respect of your booking of travel arrangements
(including documentation, payments and refunds as
applicable). The company disclaims all liability for any
technical errors, corruption of any data, unauthorized
access to your personal data, inaccuracies in information
supplied by third parties, or failure by third parties to
complete bookings where that failure is due to circumstances
beyond its reasonable control.
The company accepts no responsibility or liability for any
failure or delay on the part of any third party in providing
travel services to you howsoever caused; nor is the company
responsible for any acts or omissions of airlines travel
agents or other third parties in the course of performance
of their obligations.
- Warranties
To the maximum extent permitted by applicable law, The
company offers no warranties express or implied, regarding
this travel web site and any service or facilities provided
including the booking system. The site and any service or
facilities are being offered to you "as you see it". The
company will not be liable to you for the breach of any
alleged warranty. All warranties implied by law are
expressly excluded.
- Use of the
Booking System (online booking)
In making a hotel, air, cruise or tour package reservation
for you through the booking system, The company will be
acting as aggregator for the third parties concerned. The
company accordingly accepts no responsibility or liability
for any misunderstanding or error, whatsoever and howsoever
caused, in respect of any reservation made through the
booking system. The responsibility rests on you to read the booking
rules and ensure your booking abides by these, to carefully
check and correct any mistakes in your reservation request
and in any confirmation thereof received from third parties.
- Use of your
contact information
As user of this travel web site and any service or facility
such as the booking system, you agree and consent that The
company may use, including sharing with third parties,
your contact information (i.e. your name, e-mail and
physical / postal address and / or other contact details)
for all purposes directly connected with your reservation
request.
- Indemnity
As a condition for your use of this travel web site
including any service or facility such as the booking
system, you agree to indemnify The company from and against
any liability, damage or loss that The company incurs or
suffers as a result of any action, inaction or omission on
your part.
- Clients
Responsibility
By registering for the service, you warrant to us that you
are of sufficient legal age to use this site and to create
binding legal obligations for any liability you may incur as
a result of the use of this site. You must have sufficient
credit on your credit card, debit, bank account or any other
payment modes to meet all charges for travel services
incurred by you through this web site.
You must read the travel-specific terms and conditions at
the end of these terms and conditions and convey all
information set out in those travel-specific terms and
conditions to any other parties who may be covered by any
booking made by you.
You must keep secure any means of identification that we
provide to you in order to access the service. You must not
resell the service or any products or services accessed by
means of the service, or permit any other person, other than
adult members of your household or others with your express
permission and under your direct personal supervision, to
use your user identification to access the service. You are
responsible for all use of the service, and all transactions
entered into by means of the service, using this user
identification.
You must not use the service for any activities which breach
any laws, infringe any party's rights, or breach any
standards, content requirements or codes promulgated by any
relevant authority. You must not use the service in any way
that interferes with other users or defames, harasses or
menaces anyone. You indemnify us from and against all
actions, claims, suits, demands, liabilities, costs or
expenses arising out of or in any way connected to use of
the service by you or any other person using your membership
identification or password.
You acknowledge that copyright subsists in all software,
including HTML code, provided in association with the
Service. You must not modify, copy, transmit, display,
perform, publish, license or create derivative works from
any information or software accessed by means of the
Service. Where copying or transmission is expressly
permitted, you must not change or delete any author
attribution or copyright notice.
To secure your entitlement to the lucky draw, you must
ensure that the company confirms your payment/receipt in the
booking system.
TRAVEL SPECIFIC
TERMS AND CONDITIONS
- Fares &
Prices
Airfares and prices displayed in this website or when
booking online does not include taxes, airport charges or
other associated fees unless otherwise stated and seats are
subject to availability. The general booking form
constitutes a request only and we do not guarantee fares or
prices until the companys consultants have confirmed the
booking and fully paid for. Airline/hotel/coach/cruise/tour
availability, fare conditions and class of travel can change
at any time. Routing restrictions and other special
conditions may apply. Taxes, airport charges and any
additional costs will be advised to you when your booking is
confirmed. Bookings made through the booking engine only
constitute a request and the correctness of this request in
regards to abiding by the rules of the fare as stated is
your responsibility. Airlines and other suppliers may change
their prices without notice before receipt of confirmation
by you.
- Booking
Acknowledgement
Acknowledgement of your booking request will be sent via
e-mail or telephone call within 72 working hours of your
request being received. Please check your e-mail regularly.
Payment must be received within 48 hours of booking
confirmation unless otherwise agreed. Failure to pay for
tickets within this time results in automatic cancellation
of the booking. We accept no responsibility for loss
incurred due to automatic cancellation or failure of e-mail
delivery. Online booking is only subject to consumers whom
traveling date is minimum seven days before departure.
- Travel
Documentation
Compliance with Passport, Visa and Health requirements are
the responsibility of all individual traveller. Passports
are required for all travellers departing Singapore. Many
countries require that foreign nationals entering the
country hold a passport with at least six months validity.
The company will whenever possible assist in providing
information based on the data supply by you in the booking
form or booking system. This information as well as other
related information provided by The company .
www.planettravel.com.sg and any links within the site are
supplied in good faith and serve as a guideline only. The
final responsibility for ensuring valid documentation is
that of the individual traveller. The risk attached to
posting/couriering of travel documentation is to be borne by
you. The company will not be held responsible for tickets
lost by a third party and any charges associated with
re-issuance as well as re-delivery of documentation will be
for your account.
- Liability
We cannot accept responsibility for any travel service,
rules and conditions that are incorrectly represented within
this system. Whilst, the data and services shown are believe
to be current. We do not warrant the accuracy or
completeness of any data or services provided and to the
maximum extent permitted by any law we exclude all implied
warranties in connection with such data or services. In no
event shall we be liable for any injury, loss, claim, damage
or any incidental or consequential damages, including but
not limited to loss of profits or savings, arising out of or
in any way connected with the service provided herein.
- Booking
Cancellation and Amendment Charges
These charges will be deducted from your credit card, debit,
bank account or any other payment modes; at the time such
charges are incurred with no prior notice.
- Refund of unused services
No refunds, whether in part or full, will be made for unused air tickets, ground
transportation, meals and accommodation or sightseeing tours not taken.
- Administrative / Amendment fee
An administrative fee of S$50(or equivalent) will be charged for any amendment
after documents are processed and S$30 after reservations have been acted upon.
In any case, if there is an addition charge by the airlines, hotels, tour
operators, etc, consumer/s have to bear all the cost. Should there be any
transfer to another tour itinerary, at your request, the transfer does not
constitute an amendment but entails the cancellation of the original booking and
is subject to the applicable cancellation fees as stated above.
- Tour prices
Prices are subject to revision without notice in the event of unforeseen
circumstances like currency fluctuations, increases in hotel rates, increases in
airfares, local taxes etc. The tour price excludes pre/post tour accommodation,
laundry, room service, unspecified meals or tours, beverages, postages, excess
baggage charges, passport and visa costs airport taxes, personal and baggage
insurance, tips and all other items of a personal nature.
- Pre/Post tour accommodation and
deviation of stay / return flight
Accommodation prior to or following after a tour is permitted unless stated;
subject to the maximum validity and restrictions of the air ticket ( applicable
to booking with airfare included as part of the tour fare ). An additional
charge imposed by the airlines or operators will be borne by you. Flight and
accommodation reservations during your extension should be made prior to the
commencement of the tour. Extensions are at your own expense and transfers will
not be provided.
- Transportation
Unless otherwise specified, coach transfers are on charter basis. However, for
"seat-in-coach" transfers or tours, you will be joining regular scheduled coach
departures, which do not operate on exclusive charter basis, hence you should be
prepared to wait for the next scheduled departure.
- Tour cancellation
The Company reserves the right to cancel any tour prior to departure for any
reason whatsoever, including but not limited to insufficient number of tour
participants. Should this happen, the entire payment will be refunded without
further obligation or liability on the part of the Company.
- Reserves all Rights
The Company reserves the right to alter any route, itinerary, and/or
accommodation without prior notice to you if it shall in its reasonable
discretion think fit and necessary.
The Company also has the right to decline acceptance of any person as a member
of the tour in any occasions if it appears that the involved party is likely to
endanger the health or safety, impair the comfort and enjoyment of others on the
tour.
The Company further reserves the right to cancel any reservations if, for any
reason whatsoever, any carrier, hotel or contractor refuses to allow the person
concerned to participate in the tour.
In any of the above mentioned events, the Company's sole liability and the
person's sole remedy shall be limited to a refund of any monies paid, less the
amount for services already utilized plus administrative fees.
- Meals
Meals will be provided if specified in the tour itinerary, but no obligation
will be made if there is any change in the menu.
- Baggage
The Company assumes no responsibility for any loss or damage to baggage or
belongings that occurred while the baggage or belongings were outside its
custody or control. However, the Company will assist you in making the relevant
claims provided it does not interfere with, inconvenience, or hamper the conduct
of the tour or other members of the tour group.
- Hotel accommodation
Hotels used are as reflected in the brochures. In the event that accommodation
in the selected hotel is not available, every effort will be made for an
alternative in another hotel of similar standard. Unless specifically mentioned,
all rooms will be on "run-on-house" basis.
- Complains / Claims
Any complaints/claims have to be made within 2 weeks from the date of return. No
responsibility is accepted in respect of any complaints/claims, which are made
after 2 weeks of return.
- Other arrangements
All arrangements for the provision of transport, accommodation,
sightseeing tours and other services are made by the Company through appointed
agents only.
All exchange orders, receipts, contracts and tickets issued by the Company are
subject to applicable tariffs, terms and conditions under which the
accommodation, transportation and other services whatsoever are provided by the
hotels, transport companies, airlines, railroad lines, steamship lines, owners
or contractors concerned. By acceptance of such exchange orders, receipts,
contracts and tickets, the tour participant/s are deemed to have agreed to the
applicable tariffs, terms, and conditions. Every person participating in any
tour/holiday organized by the Company does so at his own risk with respect to
loss or damage to property or injury to person except where such loss, damage or
injury was caused by the negligence or wilful misconduct of the Company, its
employees or agents. The tour participant accepts full responsibility for
damages, losses, and expenses due to delay, sickness, weather, strikes,
quarantine, or acts of God.
The Company is only acting as an agent in organizing the respective holiday
components and will not be held responsible for any loss, damage, cost, expense
or inconvenience caused by the suppliers or appointed agents of such holiday
component. In no case shall the Company or their employees or agents are liable
for any causes outside their reasonable control or from any act or omission of
the suppliers or appointed agents.
- Travel Insurance
It is strongly recommended that all travellers obtain travel insurance against
cancellation or amendment fees as well as providing sufficient medical cover.
- Third Party Rights
For the purposes of the Contracts (Rights of Third Parties) Act and not
withstanding any other provisions set forth in this document, this Agreement is
not intended to, and does not, give any person who is not a party to it any
right to enforce any of its provisions.
- Severability of Terms & Conditions
Each provision herein is intended to be separate and independent of the others
and in the event should any of the provisions herein be determined or adjudged
to be invalid, legality and enforceability of the remaining provisions herein
shall be unimpaired and shall continue to apply.
- Changes to these Terms and
Conditions
www.planettravel.com.sg (Planet Travel Pte Ltd) has the authority and the right
to at any time it sees fit to change or modify all or any part of these terms
and conditions.
In any case of complaints or
feedbacks regarding our products and services, you can either email us at
sales@planettravel.com.sg or call us at 6286 9009. Alternatively, you can also
lodge the complaints to the BusinessTrust Secretariat in any case of
dissatisfaction in regards to the settlement of the complaints.
